      July 4th 1864. The Petition of the subscribers, Heirs and legal representatives of Peter Roth late of the township of south Whitehall in the county of Lehigh, deceased was presented setting forth: That the said Peter Roth lately died intestate, leaving a widow to wit: Magdalena, and issue ten children to wit: Christitana the wife of Charles Ringer, Lydia Ann the wife of Solomon Roth, Sally ann the wife of Jacob Long, Justina the wife of Israel Frey, Edmund D. Roth, Polly Ann the wife of Henry Bankhard, Mary Roth, Henry Roth, Amanda Roth, and Alfred Roth, the last four named being still in their minority: Mary having Daniel Henninger for her Guardian, Henry having Henry Newhard for his guardian, Amanda having Reuben Newhard for her guardian and Alfred having Charles Ringer for his guardian; and four grand children to wit: Violetta Roth, Edwin Roth, Wilkison Roth, the children of his deceased son William Roth, and ***Franklin Wisser a son of his deceased daughter Eliza, *****all of whom are also in their minority; the said Violetta, edwin and Wilkison having james T. Borhek for their guardian, and the said *****Franklin Wisser having Reuben Helfrich for his guardian;****** and that the said intestate died seized in his demesne as of fee of and in the following Real Estate, to wit: No one, A certain Messuage Plantation and tract of land situate in the township of South Whitehall aforesaid, Bounded by lands of Jesse Reichard, George Case, Jacob G. Deshler, David Eberhard, Charles Henninger and others Containing one hundred and twenty acres and one hundred and fifteen perches strict measure be the same more or less. No 2. A certain Messuage Gristmill and tract of land situate in the same township Bounded by lands of Joseph Newhard, Reuben Newhard, Jeremiah E. Brady, Elizabeth Newhard, Edward Frankenfield and others, containing nine acres and eight perches, strict measure. And No 3. A certain Messuage Tavern House and tract of land situate in the same township, Bounded by lands of George Herbster, Jesse Grim, William H. Blumer, Joseph Newhard and others containing ten acres and thirteen perches strict measure with the appurtenances. Your Petitioners therefore pray the Court to appoint and order Daniel Frey, John Kratzer, Jacob G. Deshler, David Ludwig, Jacob Lazarus, Charles Beers, and Ephraim Wenner, (who have been chosen by your petitioners for that purpose) to make partition of the premises aforesaid to and among the children and representatives of the said Intestate in such manner and such proportions as by the laws of this commonwealth is directed; but if such partition cannot be made thereof as aforesaid, then to value and appraise the same and make report of their proceedings herein according to law And they will pray &c Magdelana [her mark] Roth, Polly Bankhardt, Sarah Long, Edmund D.
