The information in this case charges that in Marshall county, December 8, 1922, the defendants, Major Bonner and Judgson Bonner, did have in their possession 10 1/2 gallons of whisky with the unlawful intent to sell the same. On this separate trial, the jury returned a verdict finding the defendant Judgson Bonner guilty as charged in the information, and fixed his punishment at a fine of $50 and confinement in the county jail for 30 days. From the judgment rendered on the verdict, he appeals. The errors assigned are that the court erred in admitting incompetent evidence, and that the verdict is not sustained by sufficient evidence. E.W. Jones, deputy sheriff, testified with W.B. Dickerson and A.M. Corder he went to Judgson Bonner's farm to search the premises for liquor, under authority of a search warrant; that they saw him walking down a path that leads from his house to a spring; that he walked on past the spring into a canyon, and seeing the officers, stopped; that they walked up to him and within a few feet from the place he stopped found a 10-gallon can containing whisky; that they left Mr. Corder there with the defendant and went to the house; Major Bonner and a man by the name of Robinson were in sitting at a table on which was a half-gallon can of whisky; that the 10-gallon can was covered with a sugar sack, and was about 20 steps from the spring; that further on down the canyon, three quarters of a mile from the house, they found a still and some whisky. W.B. Dickerson and A.M. Corder testified, in substance, Page 247 to the same facts as did witness Jones. The defendant did not testify. Upon an examination of the record, we find no prejudicial error in the rulings of the court in the admission of testimony. As to the sufficiency of the evidence, we think there can be but little doubt. The trial was in all respects fair, and we are unable to find anything in the record sufficient to warrant us in interfering with the verdict. The judgment appealed from is therefore affirmed. Tribute Paid Mrs. Bonner

Funeral services for Mrs. J. B. Bon­
ner, 95, wife' of the late Captain
Bonner, were held Thursday after­
noon at the Kingston Church of
Christ, with George Henry in charge.
Mrs. Bonner died Tuesday night at
her home three miles south of Kingston.
She was one of the pioneer citizens
of the county. Her husband, a Civil
War veteran, was a prominent and
well known farmer here. Prior to his
death he was the oldest Mason in the
county.
Children surviving include Johanson
Bonner. Mary Bonner. O. H. Bonner
and W. J. Bonner, all of Kingston;
Mrs. Curtis, Tishomingo; Mrs. Patsy
Ross, Enos, Texas, and Mrs. Sab Bon­ner,
Clayton.
Pallbearers at the funeral Included
Frank Chaffin, Frank Massey, Walton
Landram, WiU WUlU, Dick Hobbs and
Lewis Ratliff. Burial was In King­
ston cemetery, with Watts Funeral
home in charge.

Whitmal Bonner was born in 1775 to Thomas Bonner and Margaret (Jones) Bonner and died in 1821. Whitmals was 46 years old. Whitmal owned 65 acres at Shoulderbone Creek in Greene County, Georgia. He enrolled in Captain Kimbrough?s district, the Lower Battalion of Greene County. This was near his father?s place on Powell?s Creek. Whitmal did not leave a will when he died. He was married to Alice ?Allie? Selman at the time of his death. His estate was divided among his fifteen children, ten who were minors. They were: Jonathan; George W.; Whitmal Jones; Josiah M.; Bedford; William S.; Bethany; Caroline; Unknown Daughter; Mary J.; Matilda; Mattie Mae; Polly; Betsy; and Lorena.

"Whitmal Bonner (1775-1820) appears first on the tax books of Greene County in 1796 at which time he owned 65 acres on Shoulderbone Creek, and one slave. He was enrolled in "Captain Kimbrough's District, Lower Battalion of Greene County" which was near father's place on Powell Creek. He remained in the community for three or four years after which time his taxable property had increased to approximately 300 acres and 4 slaves. He appeared on the Appalachee in 1803 where he returned land for taxes in Clarke County. In 1808 he appears in Morgan County where he began to purchase land in the adjacent county of Jasper. In 1817 he bought from Isaac Newton lot number 97 in the Sixteenth District. This lot of 200 acres lies on Shoal Creek within six miles of the court house in Monticello, on the road leading to Shady Dale. Since this apparently was a highly developed farm it is believed that it became his place of residence. A two-story house of hewn logs, probably dating to this period, was standing in 1965 on this lot. A less likely location of Whitmal's residence is on lot number 224 in the Thirteenth District, acquired from William Keener in 1815. This lot lies south of Monticello on Wolf Creek. (Earlier, he had bought a fractional part of this lot from Phoebe Gibbs.) Still a third location might be lot number 15 lying also on Wolf Creek, in the Fourteenth District which had been drawn by John Pearce in the land lottery of 1806. Apparently this purchase made of John Pearce in 1808 for $550 was the first land purchased by Whitmal in Jasper County.

Whitmal died intestate in 1821, by which time hi had acquired a relatively large estate. The records of the administration of his estate indicate the his wife at this time was Alice (Allie) Selman, daughter of Col John Stedman who lived on Freeman's Creek in Clarke County. Whitmal was the father of fifteen children, ten of whom were minors. In the division of his property, each legatee received from one to three Negro Slaves."
